Warranty Statement - Holivica Pro
§1 Definitions
- Buyer — the original purchaser of the Product.
- Product — the "Holivica Pro" item.
- Warrantor — the "Holivica" online store operated by "HOLIVICA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ" (HOLIVICA LIMITED LIABILITY COMPANY), ul. Henryka Wolińskiego 24A/50, 20-491 Lublin, NIP (Tax Identification Number) 9462738041, Regon (National Business Registry Number) 52799718100000.
- Territory — The Republic of Poland.
§2 Parties and Scope of Warranty
- The warranty is granted exclusively to the original purchaser of the Product (Buyer).
- The Product covered by the warranty is the item "Holivica Pro".
- The Warrantor is the "Holivica" online store.
- The warranty is valid and applies exclusively within the territory of the Republic of Poland.
§3 Warranty Period
- The warranty period is 2 years from the date of sale of the Product.
- The Product must be purchased through the holivica.pl website.
- Defects discovered during the warranty period will be rectified within a period not exceeding 30 working days from the date of receipt of the claimed Product at the Warrantor's address.
§4 Warranty Conditions
- This warranty covers Product defects caused by faulty parts or manufacturing defects.
- The condition for the Buyer to exercise the rights under this warranty is the presentation of:
- a valid proof of purchase of the Product or a warranty card,
- the defective Product.
- The warranty does not cover:
- Products with mechanical damage not attributable to the Warrantor,
- Products damaged as a result of improper use,
- Products with damage incurred during transport,
- natural wear and tear of Product components, such as consumables, wear of the Product's surface, filters.
- Products used without filter replacement or contaminated products.
- The Warrantor has the right to refuse warranty repair in the event of:
- Finding discrepancies between the data from the documents and those on the product.
- Repairs or structural modifications of the Product performed outside the Warrantor's service.
- Use of consumable parts (fuses, filters, external power supplies, etc.) not compliant with those used for the Product by the manufacturer.
- Finding mechanical damage.
- Damage caused by random events (atmospheric discharges, flooding, etc.)
- Refusal by the Warrantor to perform a warranty repair under the terms set out in point 4 of the warranty conditions is tantamount to the loss of warranty rights, unless the Warrantor states otherwise.
- In the event of a justified suspicion of improper use, the Buyer may be denied warranty. Justified suspicions include, but are not limited to:
- Sending the Product with an inappropriate power supply.
- Sending the Product with an inappropriate power supply in a previous warranty claim case.
- Sending the Product without a power supply, or the inability to send it.
- The warranty does not exclude, limit, or suspend the buyer's rights arising from the provisions on statutory warranty for defects of a sold item.
- The claimant is obliged to deliver the equipment to the seller in its original factory packaging at their own expense. Damage caused by insufficient protection of the equipment during shipping is not subject to warranty repairs.
- The person making the claim is obliged to send the device to the seller in its factory packaging, covering the shipping costs. In the event of damage resulting from insufficient protection of the shipment, repairs will not be covered by the warranty.
- Defects discovered during this period will be repaired free of charge within a maximum of 30 working days from the moment the device is delivered by the customer. The cost of shipping the repaired device is borne by the Warrantor.
- The Warrantor undertakes to first rectify the defect by repairing the device. The Buyer has the right to exchange the equipment for a new one only if a non-repairable manufacturing defect is found and if repairs have been carried out three times during the warranty period, and the device still exhibits defects preventing its proper use. If grounds for exchanging the equipment for a new one arise, but obstacles preventing the exchange occur, e.g., unavailability of the device, the Warrantor will refund the amount paid by the customer.
- If the returned Product turns out not to be defective, the Buyer shall bear the return shipping cost of 18 PLN (approx. €4.50).
